2. TERMS & CONDITIONS
(Single Consolidated Legal Framework)
All services provided by Performance Link.Direct Ltd are subject to these Terms & Conditions. All provisions relating to performance, track use, motorsport, tuning, and dyno results are included within this document. There is no standalone track-use policy.
2.1 Services
We are Mazda MX5 NC and ND specialists, providing services ranging from routine servicing to performance, track-focused, and motorsport-related work.
All services are subject to vehicle condition, suitability following inspection, and availability.
2.2 Payment & Booking
Payment is required at the time of booking unless otherwise agreed in writing
Bookings are not confirmed until payment has been received
Payments are non-refundable unless otherwise agreed in writing or where a refund is required under UK consumer law
2.3 Cancellations, Rescheduling & Failure to Attend
Cancellations or requests to reschedule made with less than 48 hours’ notice may result in the loss of some or all of the payment made, reflecting reserved workshop time, staffing, and preparation costs
Failure to attend a booked appointment (a “no-show”) may result in the full loss of payment, unless otherwise agreed in writing
Where 48 hours’ notice or more is provided, we may, at our discretion, offer a reschedule or account credit
Refunds are not provided for changes of mind, except where required under UK consumer legislation
Any sums retained represent a genuine pre-estimate of loss and do not affect statutory consumer rights.
2.4 Commencement of Work
Work is considered commenced once inspection, diagnostics, preparation, or disassembly begins.
Once work has commenced, payments are generally non-refundable, except where required by law.
2.5 Performance, Track & Motorsport Use
Performance modifications, track preparation, motorsport activity, and spirited driving place increased stress on vehicle components.
Such work is undertaken at the vehicle owner’s risk
No guarantee is given that parts or systems will not fail during or after such use
To the extent permitted by law, we do not accept liability for mechanical failure, damage, or consequential loss arising from performance or track use
Nothing in this section limits liability that cannot be excluded under UK law.
2.6 Dyno & Tuning Disclaimer
Any power figures or performance gains are estimates only. Actual results may vary depending on vehicle condition, components, fuel, environment, and testing methods. No guaranteed results are offered.
2.7 Customer-Supplied Parts
We accept no responsibility for the quality, compatibility, or failure of customer-supplied parts
Labour charges for fitting customer-supplied parts are generally non-refundable where parts prove faulty, incompatible, or fail
We reserve the right to refuse to fit parts we reasonably consider unsafe or unsuitable
2.8 Motorsport-Only Builds & Road Legality (UPDATED)
Vehicles prepared for motorsport, track use, off-road use, or performance enhancement may not be suitable for use on public roads.
Some modifications may not be legal or suitable for road use.
It is the customer’s responsibility to ensure that all requested modifications comply with applicable road traffic, construction, and use regulations in the relevant jurisdiction.
We do not accept liability for the use of modified vehicles on public roads where such use is unlawful or non-compliant.
Nothing in this section affects liability that cannot be excluded under UK law.
2.9 Storage & Uncollected Vehicles
Vehicles should be collected promptly once work is completed.
Storage charges may apply
Vehicles left uncollected without communication may be dealt with under the Torts (Interference with Goods) Act 1977, following the required notice process
2.10 Limitation of Liability
We are not liable for pre-existing faults, wear and tear, corrosion, or age-related failure
We are not responsible for personal items left in vehicles
Subject to statutory requirements, liability is limited to the value of the work carried out
2.11 Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
